O Fim da Poluição Visual (Ou não)

Como é bom ver a cidade novamente sem todos aqueles painéis medonhos pelas calçadas, com fotos assustadoras de candidatos a Deputados e Senadores e coisas tal. Teremos segundo turno para eleição presidencial, mas pelo menos sem aqueles troços atrapalhando o caminho e visualmente poluindo o ambiente.

E falando em poluir o ambiente visual, acho que comi mosca em não abrir uma ação civil contra a cidade (ou candidatos). Desde que entrou em vigor a Lei Municipal No. 17.521/2008, segundo o Artigo 8 da dita Lei, é estritamente proibida a instalação de anúncios em:
II – vias, parques, praças e outros logradouros públicos, salvo os anúncios institucionais, com ou sem patrocínio, os anúncios orientadores, os instalados em Espaços Promocionais Públicos Criados – EPPC, bem como as placas e unidades identificadoras definidas nos termos do decreto regulamentar;
XI – passeio público, salvo na hipótese de instalação em mobiliários urbanos definidos nesta lei, que não venham prejudicar ou reduzir a mobilidade urbana das pessoas;
XIII – áreas “non aedificandi” às margens de rios, canais, lagos e açudes;
XIV – locais nos quais, pela sua forma, dimensão e localização, vierem a dificultar a acessibilidade de pessoas com deficiências ou mobilidade reduzida;

§ 2º – Nos canteiros centrais, de vias ou logradouros públicos somente serão permitidos anúncios institucionais, com ou sem patrocínio, anúncios orientadores e anúncios na forma dos arts. 50 a 53 desta Lei, desde que as calçadas permaneçam livres para a mobilidade urbana.

Coloquei apenas as partes que achei relevantes ao que vou expor. Eu posso estar errado, mas li e reli toda a Lei e não encontrei nenhum Artigo, Parágrafo ou Anexo que abrisse exceções a candidatos em campanha eleitoral. Então pra mim, todos aqueles mondromos enfileirados nas calçadas, margens de canais e na beira das praças estavam infringindo descaradamente a Lei Municipal.
Mas Leis são criadas por políticos. Conseqüentemente candidatos apoiados ou os próprios. Então basta fazer uma míope vista grosa e torcer para que ninguém "perceba" a pequena infração. Embora que para mim, Lei é pra ser respeitada. Se não respeita-se as leis em campanha, quem dirá quando assumirem seus devidos cargos!





It's good to see again our streets without all those freak political ads spread out above our sidewalks, with fearing pictures of candidates and all those stuffs. We'll have a second round on our election process, to president choice, but at least I'll haven't to see those things taking my way and polluting the visual of the city.
And talking about visual pollution, I lost a chance to bring a civil process against the city hall (or the candidates). Once that the municipal law N. 17.521/2008 started, according to the Article 8, its strongly forbidden the installation of ads (understand as those ads which a talked about) on:
II - Roads, parks, squares and other public places, except the institutional advertisements, with or without sponsorship, created for orientation, those contained in Public Spaces Promotional Created - PSPC, as well the signs and identifying units established under decree;
XI - Public sidewalk, except in case of installation in urban buildings as defined in this law, which will not impair or reduce the urban mobility of people;
XIII - areas "non aedificandi" on the banks of rivers, canals, lakes and dams;
XIV - Places where, by their shape, size and location, were to hinder the accessibility of persons with disabilities or reduced mobility;

§ 2º – In the central beds of roads or public places will only be allowed institutional advertisements, with or without sponsorship, ads, guiding ads and ads in the form of arts. 50 to 53 of this Law, in a way that the sidewalks remain free for urban mobility.

I disposed only relevant parts of the law to this post. I might be wrong, but I read and read many times this law and couldn't find anything about some exception on political seasons. So, for me, all those clumsy ads in line on our sidewalks, canals bank and squares sides were blatantly infringed the municipal law.
But laws are created by the politics. Consequently the candidates or people supported by them. So, they just have to do a myopic overlook and wish to nobody notice their "little" infraction. Although that to me, Law is made to be respected. If they don't respect the law while in campaign, who tells about when they assuming their chair!

  1. So sorry to hear you had an election recently. My deepest sympathies in you time of utter disgrace and mortification. The traffic island I drive by every did is full of signs; during the primaries I found some that had been removed and thrown in the woods while on my daily run- ah, the times are wonderful! Linda McMahon is still sending us junk mail- hopefully Blumenthal gets in instead- now there's a guy I like. You should see some of the crackpots we have running, mostly tea party idiots making a lot of noise.
